目前,我国正在实行社会主义市场经济。而市场经济必然要求有效的市场竞争机制和竞争秩序,使之在社会资源的配置与运行中发挥基础性的根本作用。但是,垄断(行政性市场垄断、非法经济性垄断、外商投资企业垄断)限制了竞争,抑制了效率,制约了技术进步及市场机制作用的发挥,降低了资源配置的总体效益,破坏了有序竞争的市场经济秩序,对我国实行社会主义市场经济体制具有严重的危害性。因此,必须制订反垄断法加以规范。
