当前的法学教育与司法考试制度的错位以及与社会职业要求的脱节的现状凸显了对法学教育的地位与意义再思考必要性。笔者拟从法学具有理论性和实践性的双重品格出发,详细阐述当前法学本科教育目标与定位应以专业教育、职业教育和通识教育相结合。针对当前法学教育重理论轻实践的各种表现的现状分析,进一步提出构建以“模拟法庭”为中心实践教学体系的思路。
The current legal education and judicial examination system and the dislocation of social and professional requirements of the status quo highlights the status and significance of legal education re-thinking the need. The author intends to set out from the double character of law and practice and elaborates that the goal and orientation of current law undergraduate education should combine professional education, vocational education and general education. According to the analysis of the current situation of the various manifestations of the light practice of the legal theory of law education, further put forward the idea of building a practical teaching system focusing on the “analog court”.
