市场经济下,反垄断法是维护竞争秩序、规范市场行为的基本法,在西方市场经济国家被誉为“经济宪法”、“经济基本法”或“自由企业的大宪章”。在整个市场经济法律体系中具有举足轻重的地位。制定反垄断法,运用法律抑制垄断、促进和保护竞争便成为现代国家,特别是市场经济国家推动经济发展的重要措施之一。
Under the market economy, the antitrust law is the basic law of maintaining the order of competition and regulating market behavior. It is praised as the “Constitution of the People’s Republic of China”, the “Basic Law of the Economy” or the “Magna Carta of Free Enterprises” in countries with western market economies. In the entire market economy legal system has a pivotal position. The formulation of antitrust law, the use of laws to curb monopoly and the promotion and protection of competition have become one of the important measures for promoting economic development in modern countries, especially in market economy countries.
