不动产善意取得是善意取得制度应用于不动产交易的具体体现。传统民法理论认为善意取得制度适用范围仅以动产为限,善意取得制度是否亦适用于不动产领域,各国立法规定不一,并且在理论研究方面,学者亦存在不同见解,我国理论界观点也不统一。本文以我国《物权法》的106条规定为基点,介绍不动产善意取得,分析其制度的不足之处,并提出相关的完善建议。
Good faith acquisition of real estate is a concrete manifestation of the goodwill acquisition system applied to real estate transactions. The traditional civil law theory holds that the scope of application of goodwill acquisition is limited to movable property, whether the system of bona fide acquisition is also applicable to the field of real estate, the national legislation has different regulations, and there are different opinions on the theoretical research and scholars’ viewpoints in China . Based on the 106 provisions of “Real Right Law” in our country, this article introduces the defects of bona fide acquisition of real estate and analyzes its system, and puts forward some related suggestions.
