本文就格拉克曼为什么会从事部落社会司法过程研究的动因进行了历史考察。研究认为,格拉克曼早年的生活与学术经历、西方列强在非洲的殖民主义行径、非洲南部不断涌现出的反对种族主义的斗争及法律人类学渐趋为一门成熟的知识体系是促使其展开部落社会司法过程研究的主要动因。然而,格拉克曼并未停留在从理论叙事到理论建构的层面,而是尝试着通过对部落社会司法过程的微观研究来勾勒并回答其所属时代的重大历史问题。
This article makes a historical review of why Grackman undertook the research on the tribal social justice process. The study argues that Grazman’s early life and academic experience, the colonialist practices of Western powers in Africa, the ongoing struggle against racism in southern Africa and the growing tendency of legal anthropology to a well-established system of knowledge have prompted it The main reason for the research on tribal social justice process. However, Grackman does not stop at the level of theoretical narration to theoretical construction, but attempts to outline and answer the major historical issues of his era through the micro-study of the tribal social justice process.
