量刑建议有助于维护被告人的辩护权,有助于全面实现公诉权,有助于法官作出科学合理的裁判,量刑规范化改革也是我国司法体制改革中的一个重要方面。虽然我国的刑事诉讼法并没有明确规定量刑建议,但在司法实践中,量刑建议已经被检察机关广泛应用。量刑建议的实施效果如何,成为今后量刑规范化改革如何推进的重要参考。对此,最高人民检察院“量刑规范化研究”课题组选取江西省为调研对象,对量刑建议做了深入细致的实证调研。
Sentencing recommendations help to defend the accused, help to achieve the full power of public prosecution, help judges to make scientific and reasonable judgments, the sentencing standardization reform is also an important aspect of China’s judicial system reform. Although China’s Criminal Procedure Law does not explicitly stipulate the sentencing recommendations, in the judicial practice, sentencing recommendations have been widely applied by the prosecutorial agencies. How does the effectiveness of the sentencing recommendations become an important reference for how to promote the standardization of sentencing in the future? In response, the Supreme People’s Procuratorate “standardized research on sentencing ” task group selected Jiangxi Province as the research object, the sentencing recommendations made in-depth and detailed empirical research.
