民间借款担保责任的确定是确定担保人是否承担连带责任的重要依据,不同的当事人对逾期借款合同的确认也会引起不同的法律后果。通过对不同当事人对逾期债务的认可引起不同的法律效力的分析,以及检察机关在民事行政诉讼中的参与,体现了法律监督的重要性。
The determination of the responsibility for guarantee of non-performing loans is an important basis for determining whether the guarantor bears the joint liability or not. The recognition of overdue loans by different parties also causes different legal consequences. The analysis of different legal effects caused by the recognition of overdue debts by different parties and the participation of procuratorial organs in civil administrative proceedings reflect the importance of legal supervision.
