中国三峡库区生态环境的保护一直是人们关注的热点,而三峡库区的生态补偿则是三峡库区生态环境能否得到有效保护,社会能否和谐、可持续性发展的关键。本文首先解释了生态补偿的概念和分类;其次,阐述了三峡库区生态补偿法律制度的现状;本文最后从尽快出台国家层面的生态补偿立法、加强三峡库区生态补偿的地方立法建设、建立三峡库区生态补偿的相关机制三方面给出了完善三峡库区生态补偿法律制度的建议。
The ecological environment protection in the Three Gorges Reservoir Area has always been a hot spot for people’s attention. However, the ecological compensation in the Three Gorges Reservoir Area is the key to whether the ecological environment in the Three Gorges Reservoir Area can be effectively protected and whether the society can develop harmoniously and sustainably. This paper first explains the concept and classification of ecological compensation. Secondly, it elaborates the status quo of the ecological compensation legal system in the Three Gorges reservoir area. At the end of this article, as soon as possible, national legislation on ecological compensation is introduced to strengthen the legislative construction of ecological compensation in the Three Gorges Reservoir area. Three aspects of the mechanism of ecological compensation in the reservoir area give suggestions on perfecting the legal system of ecological compensation in the Three Gorges reservoir area.
