小产权房问题折射出的是我国对宅基地使用权流转的法律制度和政策与现实经济环境的脱节。限制宅基地使用权流转在一定时期曾有着现实的必要性,然而随着城乡综合改革深化和新农村建设的推进,继续限制宅基地使用权流转将产生一系列无法调和的冲突和矛盾,宅基地使用权流转制度需要予以重构。
