我国的法律并没有规定“公害”的概念,学理上认为与之相关的是环境立法中“环境污染与其他公害”的用词形式。按照《环境保护法》第24条的规定,“环境污染”多指有形的有害物质导致环境质量特性方面的改变,如废气、废水、陂渣、粉尘、恶臭、放射性物质所致;“其他公害”则指无形的有害物质对环境或对人类的危害,如噪声、振动、电磁波所致。此外还寓意着在汉语语言习惯里不能以环境污染来正确表述的、或者尚未被人们所发现和确认以
