当下中国行政管理过程中,行政主体与行政相对人的关系日益紧张。主要体现在执法中的暴力行为层出不穷,暴力执法作为一种严重的行政违法行为,不仅损害了行政相对人的权益,违背了法律的基本价值,破坏政府形象,扰乱社会秩序,严重影响了和谐社会的构建。本文以某市货车司机被打事件为切入点,分析暴力执法的成因,完善暴力执法的监督体系,为构建服务型、依法执法型政府献计献策。
In the current process of China’s administration, the relations between the administrative subjects and the administrative counterparts are increasingly tense. Violence, which is mainly reflected in law enforcement, emerges in an endless stream. Violent law enforcement, as a serious administrative violation, not only damages the rights and interests of the administrative counterparts, violates the basic values of law, undermines the image of the government, disrupts social order, and seriously affects the harmonious society Construction. This article takes the truck driver in a certain city as the starting point, analyzes the causes of violent law enforcement and perfects the supervision system of violent law enforcement, offering advice and suggestions for building a service-oriented and law-based government.
