本文用文理解释的方法试图还刑法第十七条第二款以原貌,并就实践中出现的法律解释过度追求明确性的倾向提出了一些看法。

This article uses the method of textual explanation to try to return the second paragraph of Article 17 of the Criminal Law to the original appearance and puts forward some opinions on the trend of over-pursuing the clarity of the law appearing in practice.
