清末设立的资政院是清政府在仿行宪政过程中设立的一个重要的立法机关。虽然资政院院章 规定该院没有制宪权，但是随着形势的发展，资政院在实际运转过程中，由于清廷不断发布上谕而逐渐 获得了制宪权，参与了清末三部宪法文件的制订，从而成为清末最重要的制宪机关。
