近代议会主权的确立与现代行政权扩张的激烈碰撞,使得授权立法成为了一个不容忽视的问题。而在我国,进入二十世纪八十年代后,以经济建设为中心的确立,改革开放的不断深入,商品经济的承认和市场经济目标的确立,使得权力机关不得不大批量地进行立法的授权。本文通过对授权立法的概念,授权立法监督的必要性等进行分析,在此基础上对完善我国授权立法监督机制提出相关的建议。
The fierce collision between the establishment of modern parliamentary sovereignty and the expansion of modern administrative power has made the empowerment legislation a question that can not be ignored. However, in our country, since the 1980s, the establishment of economic construction as a center, the deepening of reform and opening up, the recognition of commodity economy and the establishment of market economy goals have made it necessary for the authorities to carry out large-scale legislative authorization . Based on the analysis of the conception of authorizing legislation and the necessity of authorizing the supervision of legislation, this article puts forward relevant suggestions on how to perfect the mechanism of authorizing the legislation in our country.
