十八大以来,反腐形势高压严峻,党带领我们与腐败分子坚强作斗争,坚持老虎苍蝇一起打的工作态度,同时基于政治及职务犯罪改造等原因方面考量,我国对职务犯罪量刑方面做出一些变动,这些变动是众多法律精英讨论的结果,《刑法修正案(九)》中在量刑方面比较典型又比较争议的规定当属终身监禁制度,终身监禁制度是不是与罪刑法定原则矛盾,我国终身监禁制度与国外终身监禁刑有何区别,终身监禁制度与无期徒刑有何区别,终身监禁制度与死刑存废有何渊源,终身监禁在我国适用范围以及是否可以广泛适用等等,笔者重点围绕以上几点对终身监禁制度进行探讨研究,请有兴趣读者耐心研读并斧正。
