农民合法权益保障问题已经引起广泛的关注。从现代法律精神上来讲,作为公民的农民所享有的基本权利与其他公民所享有的基本权利应当是同质的,但是在其现实性上农民在政治、经济以及社会权益的享有方面均存在非常严重的问题。在以科学发展观为指导,以建设社会主义新农村和社会主义和谐社会为目标的当今时代,必须以法律为手段,以权益保障为核心,以制度为依托,以法治为目标,来全面审视农民问题。从严格依法行政的角度讲,对农民合法权益的保障在观念上要从主观恩赐型转变为法定义务型,在方法上要从惠农减免型转变为护农给付型,在手段上要从灵活政策型转变为稳定法治型。
