重构中国的外商投资立法体系已成共识 ,中国加入WTO是其有利的外部因素。WTO协定中TRIMS协议和GATS协议在多边贸易体制中规定了国际投资问题 ,特别是其规定的国民待遇原则对中国外商投资立法的影响极大。
It has become common understanding to reconstruct the legislative system of foreign investment in China. China’s accession to the WTO is a favorable external factor. The TRIMS agreement and the GATS agreement in the WTO agreement stipulate the international investment issue in the MTS. In particular, the principle of national treatment as stipulated in the WTO Agreement has a great impact on the legislation on foreign investment in China.
