根据《中华人民共和国城镇集体所有制企业管理规定》、《深圳市城镇集体所有制企业管理规定》及有关法规的规定,深圳市集体资产管理办公室制定了《深圳市城镇集体企业产权转让管理办法》(深集体办[2001]27号),对集体企业产权转让作出了明确规定。一、城镇集体企业是指在市工商行政管理机关登记注册的,由市政府各部门、市级事业单位、市属国有企业举办或管理的集体企业。二、城镇集体企业产权转让是指依法有偿出让集体企业产权的行为,其中包括:1、集体企业产权整体或部分转让;2、集体资产出资权相关的财产权的转让。
According to the Regulations of the People’s Republic of China on Management of Collective-owned Enterprises in Urban Areas and the Regulations on the Administration of Enterprises with Collective Ownership in Urban and Town Areas of Shenzhen Municipality and Relevant Laws and Regulations, Shenzhen Collective Assets Management Office formulated the Administrative Measures on the Transfer of Property Rights of Collective Enterprises in Urban and Town Areas of Shenzhen Collective Office [2001] No. 27) made clear provisions on the transfer of property rights of collective enterprises. 1. A town collective enterprise refers to a collective enterprise that is registered in the municipal administration for industry and commerce and organized by or under the control of municipal departments, municipal institutions and municipal state-owned enterprises. Second, the transfer of property rights of urban collective enterprises refers to the act of compensating the property rights of collective enterprises according to law, including: 1) the whole or part of the transfer of property rights of collective enterprises; 2) the transfer of property rights related to the right of collective assets investment.
