2013年广东高院对“奇虎360诉腾讯滥用市场支配地位”案作出一审判决,对被告腾讯公司QQ服务的相关市场以及腾讯公司在相关市场是否具有市场支配地位进行了界定,最终判定被告腾讯并未构成滥用市场支配地位。判决一出,喧哗四起,尽管这是我国《反垄断法》实施以来最为专业的一次司法实践,但仍有质疑和意见存在。其实在传统行业相关地域市场界定已经不是容易的事情,而面对经营模式不断变化、市场结构呈动态发展的互联网领域,其相关地域市场界定必将更加复杂,网络平台间的关注度竞争理论被首次应用于反垄断司法实践之中。
