技术运用与法治建设共筑版权防护墙——写在《著作权法》第三次修改之际

“中国版权第一案”的发生进一步凸显出治理盗版的必要性与紧迫性。治理盗版乱象需要从“防”“治”两个层面共同努力。“防”的层面表现为提升所涉行业技术水平,利用相应技术措施,防范盗版发生;“治”的层面表现为充分利用既有的法律规范,惩治盗版行为。正值《著作权法》第三次修改之际,应以此为契机,完善制裁盗版的法律规范,为惩治盗版行为提供充分的法律依据。

The occurrence of “China’s first case of copyright” further highlights the necessity and urgency of managing piracy. The management of piracy disorder needs to work together from the two aspects of “prevention”, “rule”. The level of “anti-corruption” is manifested in enhancing the technological level of the industries involved and using corresponding technical measures to prevent piracy. The “governance” level is manifested in making full use of existing laws and regulations and punishing piracy. At the time of the third revision of the Copyright Law, we should take this as an opportunity to improve the legal norms of sanctions against piracy and provide ample legal basis for punishing piracy.
