本文运用比较的方法,对西方国家民事立法技术作了简明扼要的评介。全文三个部分:第一部分着重分析法国民法典、德国民法典和瑞士民法典的结构特点和语言风格;第二部分主要介绍西方近年来法典、法规起草的程序及与此有关的问题;第三部分窥探了西方国家法典、法规‘三化’(系统化、清晰化、现代化)的趋势,并介绍了西方一些法学家对法律语言的简明、精确和立法中所使用的定义、结构等概念的不同看法。
This article uses the comparative method to make a brief and concise review on the western legislation of civil legislation. The first part focuses on the structural features and language styles of the French Civil Code, the German Civil Code and the Swiss Civil Code. The second part mainly introduces the drafting procedures of the Codex and the laws of the West in recent years and the problems related to it; the third Part of the trend of the “threeizations” (systematization, clarification and modernization) of the codes and laws of the western countries, and introduced the concepts of the definition, structure and other concepts used by some western legal scholars in the simplification and precision of legal language and legislation Different views.
