中国社会的急剧变革势必导致社会纠纷的增加,这对社会纠纷的解决方式提出多样性的要求。目前,在我国的社会纠纷解决中,民间方式、行政方式和仲裁方式未能充分发挥其应有的效用,这使得司法手段被过分依赖而不堪重负。为此,我们认为有必要建立多种解纷方式有机协作的多元化纠纷解决机制,这也应当作为我国法治建设中的一项重要内容。
The drastic changes in China’s society will inevitably lead to an increase in social disputes, which demand a variety of solutions to the social disputes. At present, in our country’s social dispute resolution, the non-governmental means, administrative means and arbitration methods can not give full play to their due utility, which makes the judicial means over-dependent and overwhelmed. For this reason, we think it is necessary to establish a wide range of dispute resolution mechanisms for organic cooperation in resolving disputes, which should also serve as an important part of the legal construction in our country.
