以拍卖方式交易租赁房屋时,承租人是否能享有优先购买权的问题,我国立法上没有明确规定,各国立法和司法实践均有不同。最高人民法院《关于审理城镇房屋租赁合同纠纷案件具体应用法律若干问题的解释》第二十三条对这一问题进行了统一的规范,首先承认拍卖方式出卖租赁房屋时,承租人的优先购买权;然后对该优先权的实现提供了具体的程序,即承租人不参加拍卖的,视为对优先购买权默示的放弃;拍卖过程中,有最高应价时,承租人当场表示以此高价购买的,应当保护其优先购买的权利。
