在美国法中,支撑役权是一个重要的制度,因为它不仅对土地所有者权利保护发挥着重大作用,而且与不动产支撑利益有关的问题亦是民法研究,尤其是对我国物权法完善所不能回避的问题,倘若处理不当,不仅会引起毗邻不动产所有人之间冲突,更会给社会增添不和谐的因素。虽然我国物权法已经出台、实施,但仍存在不完善之处。鉴于此,笔者将以探讨美国法上“支撑役权”制度中的有关规定为基石,在具体分析和评价此制度之后,进行大胆的借鉴,以期冀使支撑役权与我国物权体系相融合,使物权法日臻完善。
In the American law, support and easement is an important system because it not only plays a significant role in the protection of the rights of landowners, but also issues related to the real estate support interests are civil law research, especially for the improvement of our country’s property law If not properly handled, it will not only cause conflicts among owners of adjoining real estate, but will also add disharmony to the community. Although China’s Property Law has been promulgated and implemented, there are still imperfections. In view of this, the author will explore the United States “support service ” system of the relevant provisions as the cornerstone of the specific analysis and evaluation of this system, the bold reference, with a view to enabling support services and China’s real rights system Integration, so that property law is improving.
