人权问题是当今国际社会的一个繁感话题。重视人权、促进人权是国际社会所共同关心的。但如何正视人权的法律地位,以便更好地维护人权、促进人权的发展,值得研究。本文从人权问题的历史发展,人权问题的国内性与国际性的关系,人道主义干涉与借人权干涉别国内政等几个方面,分析探讨人权的法律地位。 人权是指一个人作为人所享有或应享有的基本权利。人权是个发展的概念,最初是17、18世纪欧美新兴资产阶级启蒙思想家为了反神权、反封建而提出的。最初的人权只是作为国家内部政治生活和立法原则而存在,只涉及国内法问题,即一国政府如何对待它的国民是一国的内政,同国际法无关,国际法著作中也未提及人权问题。如美国1776年的《独立宣言》,法国1789年的《人权和公民权利直言》,以及1789年美国《宪法修正案》等涉及人权问题的法律文件都是国内法。第二次世界大战期间,法西斯侵略给人类带来了空前的灾难,特别是纳粹德国对犹太人的种族灭绝,激起了全世界人民的义愤,人们
The issue of human rights is an uprooting topic of the international community today. Emphasis on human rights and promotion of human rights are common concerns of the international community. However, it is worth studying how to address the legal status of human rights in order to better safeguard human rights and promote the development of human rights. This article analyzes and discusses the legal status of human rights in terms of the historical development of human rights issues, the domestic and international relations of human rights issues, the humanitarian intervention and the interference in other countries’ internal affairs by taking human rights as an example. Human rights refer to the basic rights that a person enjoys or should enjoy as a human being. Human rights, a concept of development, was first proposed by anti-feudalism and anti-feudalism by the emerging bourgeois enlightenment thinkers in Europe and the United States in the 17th and 18th centuries. The original human rights existed only as the internal political life and legislative principles in the country. It only covered the question of domestic law. That is, how a country’s government treats its people as the internal affairs of a country is not related to international law. Nor is there any mention of human rights issues in international law writings. For example, the United States ’Declaration of Independence in 1776, France’s 1789 “Human Rights and Citizens’ Rights,” and the legal documents on human rights issues such as the 1789 U.S. Constitution Amendment are all domestic laws.
