《辽宁省绿色食品管理办法》今年1月1日正式施行。这是辽宁省第一部针对绿色食品的地方性法规。其中对绿色食品的生产条件、标志使用、经营者的要求等一一做了明确规范。《管理办法》规定,生产基地的条件:生产环境符合国家规定标准;具有一定规模,并为绿色食品加工企业提供优质专用原料;具有完善的绿色食品生产技术服务体系和标准化的生产技术操作规程。具有健全的生产管理档案和检查制度,相适应的质量监督管理体系。《办法》明确要求:“使用与绿色食品标志相同或者近似的标志,并足以造成误认的;销售假冒绿色食品标志产品的;伪造绿色食品标志的;为侵犯绿色食品标志使用权的人提供仓储、运输、邮寄、隐匿等便利条件的;利用绿色食品标志进行虚假宣传的;对绿色食品标志使用权造成其他侵害的。”都是侵犯“绿”标使用权的行为,将由工商部门依据有关法律法规予以处罚。
