国发[2015]24号《关于大力发展电子商务加快培育经济新动力的意见》明确指出,要加快建立全国12315互联网平台,完善网上交易在线投诉及售后维权机制,研究制定7天无理由退货实施细则,促进网络购物消费健康快速发展。国发[2015]24号文为我们指明了“以网管网”的发展思路,借鉴国际先进经验,目前世界上也普遍采用在线纠纷解决机制(以下简称“ODR机制”)化解跨境消费争议。为此,本文对我国目前跨境消费的现状进行梳理,总结现有争议解决机制的弊端和不足,探讨建立我国ODR机制的初步思路,为我国跨境消费发展提供必要支撑。
