运用文献资料法、逻辑分析法,通过对青少年体育活动伤害事故法律风险成因、分类的阐述。分析了青少年体育活动伤害事故的环境法律风险:结合我国当前学校青少年体育活动伤害事故的相关法律、法规的分析,给出了伤害事故中学校与学生之间的一种教育、管理、保护的关系。另外,引入风险管理的相关理论,识别与分析了青少年体育活动给学校带来的操作性法律风险。最后提出了学校在青少年体育活动法律风险应对策略:风险防范及风险转移。
The use of documentation, logic analysis, through the analysis of the causes and classification of legal risks of sports injuries in young people. This paper analyzes the environmental legal risks of adolescent sports injury accidents. Based on the analysis of the relevant laws and regulations of injuries caused by sports activities in current adolescents in our country, this paper gives an education, management and protection relationship between schools and students in injuries accidents. In addition, the theory of risk management is introduced to identify and analyze the operational legal risks to adolescents from sports activities. Finally, the paper puts forward the strategy of coping with legal risks of sports activities in adolescents: risk prevention and risk transfer.
