《中华人民共和国劳动合同法》2007年6月29日经过第十届全国人民代表大会常务委员会第28次会议通过,于2008年1月1日起施行。《劳动合同法》第二条规定:“中华人民共和国境内的企业、个体经济组织、民办非企业单位等组织(以下称用人单位)与劳动者建立劳动关系,订立、履行、变更、解除或者终止劳动合同,适用本法。国家机关、事业单位、社会团体和与其建立劳动关系的劳动者,订立、履行、变更、解除或者终止劳动合同,依照本法执行。”
The Labor Contract Law of the People's Republic of China passed the 28th meeting of the Standing Committee of the Tenth National People's Congress on June 29, 2007 and came into force on January 1, 2008. Article 2 of the “Labor Contract Law” stipulates: “Enterprises, individual economic organizations, private non-enterprise units and other organizations within the territory of the People's Republic of China (hereinafter referred to as the employing units) shall establish labor relations with workers and shall conclude, carry out, alter, Termination of a labor contract shall be governed by this Law: ”State organs, public institutions, social organizations and laborers who establish labor relations with them shall conclude, carry out, alter, terminate or terminate a labor contract and shall be executed in accordance with this Law.
