一、立法理论滞后行业实际结论的提出我国房地产管理在“政策调整”的道路上蹒跚数十年后,通过对“依法管理”的理论和实践的探索,得出了房地产业发展必须实现管理法制化的共识。而事实上,在社会主义国家建立市场经济是十分艰巨的系统工程,其中房地产由计划经济向市场经济的转型必然是一个复杂的历史过程。我国近期的房地产业的发展,时常驻步引颈。正在逐步建立健全多种形式责任明晰的权属关系、收益分配关系,并逐渐在其生产、流通、消费、分配环节上减少政府对价格等市场标尺的不适当干预,切合实际地保障当事人合法权益,这一历程客观上说明实际工作
