本文以《第二银行指令》的规定为基础,论述了欧共体银行法中颇具特色的三项基本原则,即“以最低限度的协调”为基础的相互承认、由“母国控制”支持的单一银行许可、对第三国银行的互惠待遇。本文指出,欧共体银行法对于国际银行法律制度的发展提供了不可多得的经验。中国应适当借鉴欧盟经验完善国内金融立法及监管制度,尤其是:金融立法应将金融业的自由化与审慎监管两者并重;在市场准入管制中应灵活运用互惠原则,以适度开放国内市场并开拓海外市场
Based on the provisions of the Second Bank Directive, this article discusses the three basic principles of the ECB’s banking law that are based on mutual recognition of “coordination at a minimum level” and supported by “home country control” Single Bank License, Reciprocal Benefit to Third Party Banks. This paper points out that the ECB law provides a rare experience for the development of the legal system of international banks. China should make proper use of the EU experience to improve the domestic financial legislation and regulatory system. In particular, financial legislation should give equal emphasis to both liberalization and prudential regulation of the financial industry. In the control of market access, the principle of reciprocity should be used flexibly to liberalize the domestic market And open up overseas markets
