我们所处的是一个高度现代化、信息化的社会。随着科学技术的发展,知识产权与工业设计的联系日益紧密,工业设计受知识产权的影响也越来越大。因为工业设计本身是一种具有创造性的活动,创造性思维的运用对设计的结果起着至关重要的作用。而创造性思维又是要在知识产权保护的基础上得到发挥与进步的。同时由于我国加入世界贸易组织,在知识产权方面对于我国企业带来了巨大的冲击,使我国的企业处于前所未有的弱势状态。在这种局面下,我们面对着一个如何正确认识工业设计和知识产权关系的问题。在设计领域中,“知识产权”这一新课题是值得我们一起思考与回应的。
We are in a highly modern and informative society. With the development of science and technology, the connection between intellectual property and industrial design is getting closer and closer, and the influence of intellectual property on industrial design is also getting bigger and bigger. Because industrial design itself is a creative activity, the use of creative thinking plays a crucial role in the design’s outcome. And creative thinking is to be played on the basis of intellectual property protection and progress. At the same time, because of China’s accession to the World Trade Organization, it has brought tremendous impact on the Chinese enterprises in terms of intellectual property rights, leaving our enterprises in an unprecedented vulnerable state. In this situation, we face a problem of how to correctly understand the relationship between industrial design and intellectual property. In the field of design, the new topic of “intellectual property” is worth thinking and responding with.
