4月14日,国资委和财政部公布的《企业国有产权向管理层转让暂行规定》(以下简称《暂行规定》),对企业国有产权向管理层转让提出了规范性要求,并明确了相关各方的责任。《暂行规定》出台的目的,是规范国有企业改制和产权转让行为而不是停止改革,并确保国有资产“流动而不流失”。
On April 14, the Interim Provisions on the Assignment of State-owned Property Rights to Management by the SASAC and the Ministry of Finance (hereinafter referred to as the Interim Provisions) put forward normative requirements on the transfer of state-owned property rights to the management and clarified the relevant Responsibilities of all parties. The purpose of the promulgation of the Provisional Regulations is to standardize the restructuring of state-owned enterprises and the transfer of property rights instead of stopping the reform and to ensure that state-owned assets “flow without loss.”
