当前,农村集体违法建设形势严峻,直接影响我国新型城镇化目标的实现。究其原因,城乡二元土地制度所带来的土地违法暴利是其诱因。同时,现行“乡政村治”制度执行不力,农村集体组织职能异化、财权事权失配严重、集体干部相关激励机制缺乏等,都使得农村集体违法建设在所难免。因此,要解决农村集体违法建设,必须对现行农村土地制度进行系统化改革,同时进一步落实农村自治制度,并对农村集体组织进行针对性改革。
At present, the situation of collective illegal construction in rural areas is grim, which has a direct impact on the realization of the goal of new-type urbanization in our country. The reason, urban and rural dual land system brought about by illegal profits of land is its incentive. In the meantime, the existing system of “township government and village governance” is not enforced, the functions of the rural collective organizations are alienated, the powers and powers are misbalanced seriously, and the lack of collective cadre-related incentive mechanisms all make it inevitable for the collective illegal construction in rural areas. Therefore, in order to solve the collective illegal construction in rural areas, we must systematically reform the current rural land system and at the same time further implement the system of rural self-government and carry out targeted reforms in rural collective organizations.
