在现代国家的正义系统中,司法起到维护正义的功能,旨在将因违法行为造成的正义失衡状态修复原状,实现正义。而刑事司法针对的对象是犯罪行为,直接关系到公共安全和公民权利的救赎。正因为如此,刑事司法的价值从来不单单体现在个案的公正之中,更是辐射到其对整个社会的法治价值传递上。因为很大程度上,社会领域的法治认知与理念嬗变,主要来源于人们对刑事司法的直观感受。问题是,什么样的刑事司法才是优良的呢?才能让老百姓产生好的法治印象呢?才有助于社会法治理念的正向塑造呢?今年2月,一个名为英国最高法院的新账户出现在推特上,立即引起众多网民的猜测。
