著作权保护的是“思想”的表达方式而非“思想”本身,因此一般来说,在著作权侵权纠纷中,根据“接触”加“实质性相似”的原则,如果当事双方的表达方式同一或者是类似,基本都可以认定为著作权侵权行为发生。但该原则在涉及“有限表达”时,应予以排除适用,以符合《著作权法》保护和鼓励科学技术进步、促进文化发展的立法宗旨。司法实践中,涉及“有限表达”的案例并不多见,因此,如何恰当的理解和适用“有限表达”原则,是每一个法律从业人员应当慎重以待的。
