受西方开放式文化的影响,传统婚姻家庭观发生了很大的变化,非婚同居成为我国社会广泛关注的问题,针对这一问题,我国目前尚未形成规范性的法律制度,容易出现一些法律纠纷,因此探究我国非婚同居相关性法律制度具有非常重要的意义。本文阐述了非婚同居的构成要件,研究了非婚同居的法律规制及其中存在的问题,在维护当事人合法权益及婚姻法的基础上,对非婚同居的法律地位进行理性的分析,结合我国基本国情制定规范、合理的非婚同居法律制度,充分发挥法律制度的优势。
Affected by the Western open culture, the traditional marriage and family view has undergone great changes. Non-marital cohabitation has become a widespread concern in our society. In response to this problem, China has not yet formed a normative legal system and is prone to legal disputes Therefore, it is of great importance to explore the legal system of non-marital cohabitation in China. This article expounds the constitutional elements of non-marital cohabitation, studies the legal regulation of non-marital cohabitation and its existing problems. On the basis of safeguarding the legitimate rights and interests of the parties concerned and the law of marriage, this article makes a rational analysis of the legal status of non-marital cohabitation, National conditions to develop a standardized, reasonable non-marital cohabitation legal system, give full play to the advantages of the legal system.
