我国正在积极开展行政审批改革,其实质主要就是进行行政审批的清理工作。由于历史原因,我国积累了大量的冗杂的行政审批事项,各种行政活动都被冠名为“行政审批”。伴随着法制建设,行政审批的事项范围变窄了,行政审批事项存在的依据、程序都法定了。因此,本文力图从法律、法规的具体规定与行政审批事项的办理时限这两个角度来研究行政审批事项分类管理的问题。
Our country is actively carrying out the reform of administrative examination and approval, and its essence is mainly the work of clearing administrative examination and approval. Due to historical reasons, our country has accumulated a large number of complicated administrative examination and approval matters, and various administrative activities have been named “administrative examination and approval.” With the construction of the legal system, the scope of administrative examination and approval has become narrower. The basis for the examination and approval of administrative examination and approval matters and the procedures are all statutory. Therefore, this article tries to study the classification management of administrative examination and approval items from the two perspectives of the specific provisions of laws and regulations and the time limit of administrative examination and approval items.
