美国对伊拉克发动的反恐怖战争属于武装冲突,虐囚行为应适用国际法。被关押人员应被赋予战俘或平民的身份,因此,必须符合《日内瓦公约》的有关规定。实施虐囚行为的个人应承担个人责任;国家也应承担相应责任。
The U.S. anti-terrorist war against Iraq belongs to an armed conflict. The abuse of prisoners should be governed by international law. Detainees should be given the status of prisoners of war or civilians, and must therefore comply with the relevant provisions of the Geneva Conventions. Individuals who commit abuse of prisoners should take personal responsibility; the state should also assume corresponding responsibilities.
