房地产信托是将信托和房地产开发项目结合在一起的新型融资方式,在我国快速兴起并发展起来。但是,信托法律制度在我国尚属新兴事物,各方面的法律制度可以说并不完善或者说依然空白。本文通过对房地产企业融资多元化渠道的分析,指出信托方式的优越性,之后简要分析了房地产信托的三种运作模式与风险性,综上所述,对我国现行房地产信托法律制度的完善与发展提出一些建议。
Real estate trust is a new financing method combining trust and real estate development project, which is rapidly rising and developing in our country. However, the legal system of trust is still a new phenomenon in our country. The legal system of all aspects can not be said as perfect or still remains blank. This article points out the superiority of the trust method through the analysis of diversified channels of real estate financing, and then briefly analyzes the three operation modes and risks of the real estate trust. Based on the above, this article analyzes the perfection and development of the current legal system of real estate trust in our country. come up with some suggestions.
