出于寻求版权人与社会公众之间利益平衡的目的,对作者专有权利加以限制的合理使用制度被引入版权法。时至今日,由数字技术的发展及互联网的普及而引起的版权内容的扩张已不可避免地对合理使用制度产生了冲击与影响。因此,就有必要将合理使用制度置于网络技术的视野之下予以重新审视。本文拟从分析合理使用制度确立的原因及其内涵入手,探讨网络环境下版权法新发展对合理使用制度的冲击,并我国合理使用制度的完善提出建议与看法。
For the purpose of seeking the balance of interests between the copyright owner and the general public, the fair use system that restricts the exclusive rights of authors is introduced into the copyright law. To date, the expansion of copyright content caused by the development of digital technologies and the popularization of the Internet has inevitably had an impact on the fair use system. Therefore, it is necessary to re-examine the system of fair use under the view of network technology. This article intends to start with the analysis of the reasons for establishing the fair use system and its connotation, and to discuss the impact of the new development of copyright law on the fair use system in the network environment and to put forward suggestions and opinions on how to perfect the fair use system in our country.
