确定拆迁房屋面积,是补偿安置的前提、依据,也是拆迁的基础性工作。面积是否正确,直接关系到拆迁双方当事人的切身利益。确定面积基本通过两种途径:1.对所拆迁房屋直接丈量;2.按照《房屋所有权证》上所记载的面积确定。第一种情况主要在房屋所有权证未发而拆迁又相当紧迫的时候。当房屋所有权证发放,被拆迁人持有房产证时,则按所有权证记载的面积确定。房屋使用性质鉴定是否正确也直接关系到拆迁双方当事人的利益。从使用性质看,房屋大致可分为两大类:住宅与非住宅。非住宅大致可分为营业用房,生产用房,办公用房,一般性用房。按地段营业用房又可分为临街店面,非临街营业用房,一般性用房可分为:柴间、厕所、畜牧用房。
