新《婚姻法》首次确立了离婚损害赔偿制度,这在立法上是修正后的婚姻法的亮点之一,是满足时代的需要,是立法的进步,是使司法更加完善的措施之一。本文从离婚损害制度的构成要件、离婚损害赔偿制度的过错认定、离婚损害赔偿制度的赔偿方式和离婚损害赔偿制度的不足等方面展开论述。但现行的离婚损害赔偿制度有严格的条件,在立法上尚待完善,在司法实践中遇到的问题也不容忽视。
The new “Marriage Law” first established the system of damages for divorce, which is one of the highlights of the revised Marriage Law in legislation. It is to meet the needs of the times, is the progress of legislation, and is one of the measures to make the judiciary more perfect. This article starts from the constitutional elements of the divorce damage system, the fault identification of the divorce damage compensation system, the compensation method of the divorce damage compensation system and the insufficiency of the divorce damage compensation system. However, the current system of compensation for damages for divorce has strict conditions and remains to be perfected in legislation. The problems encountered in judicial practice can not be ignored.
