关于构建我国未成年犯罪人前科消灭制度的思考

未成年人前科消灭制度,从我国司法实践的角度来说是一个全新的课题,从未成年人权利保护这一基本点出发,制度设立是必要的,但观念的更新更加迫在眉睫。全国政法系统第三个五年改革纲要给我们提出了新的课题,我们要从司法改革的高度、保护人权的深度、构建和谐社会的广度来思考这个问题,早日使未成年人前科消灭制度在我国立法化、实践化。

The system of eliminating the criminal record of minors is a brand-new subject from the perspective of judicial practice in our country. Since the basic point of the protection of juvenile rights has not been established, the establishment of the system is necessary. However, the renewal of concepts is even more imminent. The outline of the third five-year reform of the national political and legal system has raised a new issue for us. We should think about this issue from the perspective of judicial reform, the depth of human rights protection, and the building of a harmonious society.
