就业歧视体现了雇主的用工自主权与雇员的就业平等权的冲突。用工自主权过分扩张产生的就业歧视会损害社会整体利益,妨害我国市场经济健康发展。较之显性歧视,就业歧视中的隐性歧视危害更甚。由于就业隐性歧视手段的隐蔽性,受害者无法像显性歧视中的受害者一样向法律寻求救济。合理界定隐性歧视的理性边界,有利于实现对隐性歧视进行法律规制,实现法的公平、正义、平等和安全价值,有利于和谐社会的构建。
Employment discrimination reflects the conflict between employer's employment autonomy and employee's right to employment equality. Employment discrimination resulting from over-expansion of labor autonomy will undermine the overall interest of society and hinder the healthy development of China's market economy. Implicit discrimination in employment discrimination is more harmful than explicit discrimination. Due to the covert nature of the employment-based discriminatory approach, victims can not seek redress from the law as victims of explicit discrimination. Reasonable definition of the hidden boundaries of the rational discrimination is conducive to the realization of the legal regulation of hidden discrimination, to achieve the law of fairness, justice, equality and security value, is conducive to the construction of a harmonious society.
