随着国人对海外文化的热捧,比如国人对国外影视作品的喜爱超过对国内的影视作品的喜爱,特别是国外制作的大片,影视作品中运用到的技术特效是国内无法赶超的,再早些年前,当这些大片在国外上映的时候,要想在国内网站上观看带有中英文字幕的电影很难,有时观看的到也需要花很长时间等。随着网络技术的发展,以及掌握多种语言技能的人才出现,在短时间内观看到带有中英文字幕的新片较之以前方便许多。影片中的中文字幕是字幕组对剧本内容进行翻译的成果,但在此涉及许多的法律问题,如:字幕组的翻译行为是否侵犯了版权人的翻译权?字幕组制作出的字幕与影视作品相结合是否构成对原影视作品的侵权?本文中主要探讨这两方面的问题以及其相关法律条文,以及对于这种侵权行为的提出相关的解决方法。
