科技期刊著作权流转是随着科技期刊的数字化出版、产业链主体的多元化而出现的一个市场现象,但在市场经济发展的自发性下,流转过程中出现了诸多问题,著作权转让及许可使用协议的不规范性、著作权限制与例外的弱化等成为了频繁引起著作权纠纷、影响科技期刊良性发展的主要原因。主体法治意识薄弱、法律法规及行政管理措施的不完善等也是影响著作权流转的主要因素。著作主体间利益失衡的问题,不仅对我国相关著作权法律法规的完善与发展是一种挑战,同时也要求我国科技期刊主管单位加强行政管理职能,提高期刊著作权的管理力度,推进整个行业各主体的法制意识。以著作权共享为核心的开放存取出版模式,将是解决我国科技期刊著作权流转问题的一种新途径。

The unbalanced interests between the subjects of the writings not only bring challenges to the perfection and development of the relevant copyright laws and regulations in our country, but also require the supervisory units of sci-tech periodicals in China to strengthen their administrative functions, improve the management of periodical copyright, Legal awareness. The open access and publication mode with copyright sharing as the core will be a new way to solve the problem of copyright circulation of Chinese sci-tech periodicals.
