非法经营罪一直是刑法理论和实践中广泛争论的问题。而现今许多观点认为,非法经营罪在实践中的运用,逐渐脱离了立法原意,成为口袋罪。本文试以从内涵到外延的逻辑顺序,对非法经营罪做收缩性反思。本文认为非法经营罪的违法性实质在于破坏市场秩序,并在此基础上通过对法条的解释和案例的分析得出应对其应进行限制性解释的结论。
Illegal business crime has always been a controversial issue in the theory and practice of criminal law. However, many viewpoints at the moment suggest that the use of the crime of illegal business operation in practice gradually departs from the original intention of the legislation and becomes a crime of pocketing. This article tries to make a contractive reflection on the crime of illegal business by taking the logical order from connotation to extension. This article argues that the essence of illegality of illegal business crime is to undermine the market order. On the basis of this, the article concludes that the law should be restrictively interpreted through the interpretation of the law and the case analysis.
