在我国,职工代表大会是企业职工对企业行使民主管理权利的机构,是企业民主管理的基本形式,是我国基层民主政治建设的组成部分,也是我国企业领导制度的重要组成部分,是贯彻落实党的全心全意依靠工人阶级根本指导方针的主要载体。我国颁布的《宪法》《公司法》《工会法》和《劳动法》等法律法规对职工代表大会制度都有明确的规定和要求。党的十六大报告再一次强调,坚持和完善以职工代表大会和其它形式的企事业民主管理制度,保障职工的合法权益。
In our country, the workers’ congress is the mechanism by which the staff and workers of enterprises exercise the democratic management right over the enterprises, is the basic form of the democratic management of enterprises, is an integral part of the construction of grassroots democracy in our country, and is also an important component part of our country’s enterprise leadership system. Wholeheartedly relied on the main vehicle for the fundamental guidelines of the working class. China promulgated the “Constitution”, “Company Law” “Trade Union Law” and “Labor Law” and other laws and regulations of the workers congress system has a clear rules and requirements. The report of the 16th National Congress of the CPC once again emphasizes that we should insist on and perfect the democratic management system of workers’ congresses and other forms of enterprises so as to safeguard the legitimate rights and interests of employees.
