本文从实证主义立场分析了行政伦理中的权利与义务的关系,指出在行政伦理语境下,权利与义务的关系主要表现为权利与责任的关系,即公民权利是行政权力的依据,责任政府是对公民权利的回应。权利与义务关系的实证分析意味着必须超越传统行政伦理学的规范式或德性论的立场。
This paper analyzes the relationship between rights and obligations in administrative ethics from the positivist standpoint, pointing out that in the context of administrative ethics, the relationship between rights and obligations is mainly manifested in the relationship between rights and responsibilities, that is, civil rights are the basis of administrative power, and the responsible government It is a response to civil rights. An empirical analysis of the relationship between rights and obligations means that we must go beyond the normative or ethnological arguments of traditional administrative ethics.
